Захист культурної спадщини в умовах повномасштабної російсько-української війни: уроки і перспективи

Стаття присвячена питанням оптимізації захисту культурної спадщини України в умовах російської агресії. Доводиться, що агресор свідомо вдається до культурного геноциду, завдаючи удару по історичним пам’яткам, культурним, релігійним, освітнім об’єктам. Мета дослідження – узагальнити типові проблеми у справі збереження культурної спадщини України під час повномасштабної російсько-української війни, винести з них уроки та визначити перспективи. В умовах війни на перше місце виходять превентивні дії, спрямовані на мінімізацію втрат від ворожих атак. Такі дії включають завчасну евакуацію рухомих цінностей з прифронтових територій та укриття нерухомих пам’яток від можливих повітряних атак. Важливо комплексно та системно підходити до питань фіксації актів вандалізму і документації військових злочинів проти об’єктів культурної спадщини. Виправданою за умов військового стану є обрана Міністерством культури та інформаційної політики України стратегія на створення цифрових копій культурних цінностей, включаючи музейні експонати, картини, книги, архівні документи тощо. Це дозволить, по-перше, зберегти інформацію про пам’ятку навіть за умов знищення самого матеріального носія, а по-друге, довести національну приналежність пам’ятки у разі незаконного вивезення за кордон, обґрунтовано вимагати повернення цінностей або реституції. Одним з напрямків оптимізації пам’яткоохоронної діяльності є приведення норм вітчизняного законодавства до міжнародних стандартів, що дозволить напряму, без апеляції до статей Гаазької та Паризької конвенцій здійснювати судово-слідчі процедури на основі національного права. У статті йдеться про важливість перспективного планування відновлення культурної спадщини України у післявоєнний період, необхідність повернення незаконно вивезених за кордон цінностей та реституції.
